Privacy is important to MEMORY MY WAY INC (DBA MAE). This policy describes the type of information we may collect from you or that you may provide when you use our mobile application (the “App”), and your engagement with our services, including, without limitation, when you download, install, register with or access the App, engage with us through the App by uploading photos or otherwise, or when you make any purchases (such as a paid subscription) (collectively, the “Services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information. Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. When you use our Services, you are consenting to the collection, use, sharing, and storage of your Personal Information as described below.
This Privacy Policy supplements and is incorporated into our Terms of Service which, together with this Privacy Policy, govern your use of the Services. This Privacy Policy applies solely to information collected by the Services. Capitalized terms used but not defined in this Privacy Policy have the meaning given to them in the Terms of Service. The terms “Memory My Way” or “us” or “we” or “our” refer to MEMORY MY WAY INC, a Delaware corporation, the owner of the Services. The terms “you” or “your” refer to the user or viewer of the Services.
Information Collection
We collect information from those who visit and interact with our Services, including information:

Information You Provide to Us
You may provide information to us directly, or to service providers that act on our behalf, when you use the Services. The information you provide depends on how you interact with the Services. The information we collect through our Services may include:

Information that you provide by filling in forms on our App, including but not limited to information provided at the time of creating an account for the Services.

If you grant us permission to access all or a portion of your mobile device’s photo library, we will upload the photos in your device’s photo library that you grant us permission to access to our hosted servers so that such photos may be processed by the Services. You may revoke permission to access your mobile device’s photo library through your account settings or the settings on your mobile device. Please note that when you upload your photos to our Services or give us permission to access the photos stored on your mobile device, your photo content may also include related image information such as the time and the place (general, not specific) your photo was taken and similar “metadata” captured by your image capture device.

Your responses to optional surveys, polls, or other similar items that we might distribute.

If you grant us permission to access your mobile device’s photo library, you confirm that you have all required rights, approvals and consents from any third parties, if applicable, to use their photos or photos on which other individuals are shown through the Services. Your photos are uploaded and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your photos. Information We Collect Through Automatic Means
As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, actions, and patterns, including, but not limited to:

Details of your visits to our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Services.

Information about your mobile device and internet connection, including your IP address, the device’s unique device identifier, operating system and version, mobile network information, device type and device language.

The information we collect automatically only contains statistical data and does not include Personal Information, but we may maintain such statistical data or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to:

Information We Collect From Third Parties
In addition to the information we collect from you or through automatic means, we may collect information that is publicly available or from third-party sources. We may combine this information with your Personal Information for the purposes described herein. The information we collect from third-party sources includes, but is not limited to:

Information about you from payment and transaction fulfillment providers, such as payment confirmation details, and information about the delivery of products you have purchased through shopping features.

Interactions with Third Parties
Articles and other information shared on this site may include embedded content (e.g. videos, images, articles, etc.). These third parties may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content.
In addition to the third-party content above, we currently engage Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to help us analyze how users use the Services. Google Analytics uses cookies and similar technologies to collect information that does not include your Personal Information to help us evaluate your use of the Services, compile reports on Services activity and provide other information related to Services usage. We may permit Google and, from time to time, other such third-party analytics providers to combine information collected through our Services with information collected from third-party services, and these analytics providers may use this information to help us better understand our users. We also utilize OpenAI's application program interface to power portions of the AI functionality of our Services. We expressly disclaim any and all liability for the actions of third parties. The privacy practices of any third parties are outside the scope of this Privacy Policy and their use or disclosure of your information (including your Personal Information) will be governed by their own privacy practices or policies. We encourage you to review the privacy practices or policies of those third parties.

We use information that we collect about you or that you provide to us, including any Personal Information:

To analyze your photo content and metadata to help you tag and organize your photos to create products, to make personalized product suggestions and recommendations to you, such as showing you how your pictures may look in a collage or other products. We may send you reminders and suggestions based on the information you include in your projects, such as birthdays and anniversaries.

To provide you with information, products, or services that you request from us or information, products, pricing models or services that we think you may be interested in.

Information and Photo Retention
We retain the information we collect from you for as long as we deem necessary to fulfill the purposes outlined in this Privacy Policy unless otherwise required and authorized by applicable law.
We will retain your photos for as long as you maintain an account with us and grant us permission to access your photos. You may decide to delete all of your photos in your account and delete the app. In order for your photos and information to be permanently removed from the App, our servers and our hosting providers’ servers you must request we do so. Your Access to and Control Over Information
We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

Security
We take precautions to protect your information. When you submit sensitive information via the Services, your information is protected both online and offline. Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way.
The computers servers in which we store personally identifiable information are kept in a secure environment.
We will make our best efforts to protect your information, but we cannot, however, ensure or warrant the security of any information that you transmit to us or store on the Services, and you do so at your own risk. We also cannot guarantee that such information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or administrative safeguards.
Children’s Online Privacy Protection Act
The Services are intended for general audiences 18 years of age or older. The Services are not directed to children under 13 years old. We do not target the Services to children under 13, and we do not intentionally collect any information from users under 13. If you are under 13, do not use or provide any information through the Services. If you become aware that a child has used the Services, and we may have Personal Information about a user under 13, please contact us at hello@meet-mae.com so we may delete the information.

State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information.

International Users
The Services are hosted in the United States and are intended primarily for visitors located within the United States. If you choose to use the services from outside the United States or in a jurisdiction with laws governing data collection and use that may differ from the laws of the United States, you hereby authorize and consent to the transfer of your Personal Information outside of such region and to the United States, or any other jurisdiction to be determined in our sole discretion, for data storage and processing purposes.
While we do not specifically target our goods or services to individuals outside of the United States, it understands that certain App visitors may be considered “data subjects” for whom the processing of Personal Information would normally be subject to REGULATION (EU) 2016/679 (“GDPR”) or the U.K. General Data Protection Regulation (“UK GDPR”) (each, a “Covered Person”).
While Memory My Way is not subject to GDPR or the UK GDPR because it does not target its goods and services to individuals outside of the United States, it voluntarily offers Covered Persons the rights described below:

If we process or use the user’s Personal Information, we shall endeavor to ensure, by implementing suitable measures, that the user’s Personal Information is accurate and up to date for the purposes for which it was collected. If the user’s Personal Information is inaccurate or incomplete, the user may obtain the rectification of such Personal Information. The user may obtain the erasure or restriction of processing of the user’s Personal Information in situations where no legitimate business purpose exists, or the further storage is unnecessary.
