This policy describes the type of information we may collect from you or that you may provide when you use our mobile application (the “App”), and your engagement with our services, including, without limitation, when you download, install, register with or access the App, engage with us through the App by uploading photos or otherwise, or when you make any purchases (such as a paid subscription) (collectively, the “Services”) and our practices for collecting, using, maintaining, protecting, and disclosing that information. Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. When you use our Services, you are consenting to the collection, use, sharing, and storage of your Personal Information as described below.

This Privacy Policy supplements and is incorporated into our Terms of Service which, together with this Privacy Policy, govern your use of the Services. This Privacy Policy applies solely to information collected by the Services. Capitalized terms used but not defined in this Privacy Policy have the meaning given to them in the Terms of Service. The terms “Memory My Way” or “us” or “we” or “our” refer to MEMORY MY WAY INC, a Delaware corporation, the owner of the Services. The terms “you” or “your” refer to the user or viewer of the Services.

Information Collection

We collect information from those who visit and interact with our Services, including information:

By which you may be personally identified, such as: your name; date of birth; geographic information; email address; home address; order and payment information; and comments, requests, and other information you may offer (“Personal Information”);

That is non-identifiable information related to your access to our Services, including, but not limited to, your IP address, App visits, page response times, download errors, length of visits to certain pages, and page interaction information.

We collect the above information directly from you when you provide it to us, automatically as you navigate the Services, and from third-party service providers as described below.

Information You Provide to Us

You may provide information to us directly, or to service providers that act on our behalf, when you use the Services. The information you provide depends on how you interact with the Services. The information we collect through our Services may include:

Information that you provide by filling in forms on our App, including but not limited to information provided at the time of creating an account for the Services.
If you grant us permission to access all or a portion of your mobile device’s photo library, we will upload the photos in your device’s photo library that you grant us permission to access to our hosted servers so that such photos may be processed by the Services. You may revoke permission to access your mobile device’s photo library through your account settings or the settings on your mobile device. Please note that when you upload your photos to our Services or give us permission to access the photos stored on your mobile device, your photo content may also include related image information such as the time and the place (general, not specific) your photo was taken and similar “metadata” captured by your image capture device.
Records and copies of your correspondence (including email addresses) if you contact us.
Your interactions with our AI digital memory manager.
Your responses to optional surveys, polls, or other similar items that we might distribute.
Details of transactions you carry out through our App and of the fulfillment of your orders. You may be required to provide financial information before placing an order through our Services.
Posts you may contribute to the Services.
Your search queries on the Services.

If you grant us permission to access your mobile device’s photo library, you confirm that you have all required rights, approvals and consents from any third parties, if applicable, to use their photos or photos on which other individuals are shown through the Services. Your photos are uploaded and transmitted to others at your own risk. Please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of third parties with whom you may choose to share your photos. Therefore, we cannot and do not guarantee that your photos will not be viewed by unauthorized persons. For more information, please visit our [Terms of Service].

Information We Collect Through Automatic Means

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, actions, and patterns, including, but not limited to:

Details of your visits to our Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Services.
Information about your mobile device and internet connection, including your IP address, the device’s unique device identifier, operating system and version, mobile network information, device type and device language.
Information regarding the version of the Services that you are using and the country version of the app store from which you downloaded the Services.
Details about your in-App purchases.
Details confirming the existence of a relationship between us and confirmation that a relationship ended, if applicable (e.g., subscription order, payment confirmation, subscription cancellation, subscription price & duration, if you used the App).
Image information such as the time and the place a photo was taken and similar metadata.

The information we collect automatically only contains statistical data and does not include Personal Information, but we may maintain such statistical data or associate it with Personal Information we collect in other ways or receive from third parties. It helps us to improve our Services and to deliver a better and more personalized service, including by enabling us to:

Estimate our audience size and usage patterns.
Store information about your preferences, allowing us to customize our Services according to your individual interests.
Speed up your searches.
Recognize you when you return to our Services.

The technologies we use for this automatic data collection may include:

Cookies (or browser cookies). A cookie is a small file placed on your mobile device. You may refuse to accept cookies by activating the appropriate setting on your browser or mobile device. However, if you select this setting you may be unable to access certain parts of our Services. Unless you have adjusted your settings so that it will refuse cookies, our system will issue cookies when you access the Services.
Web Beacons. Our Services and our emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain content and verifying system and server integrity).
Flash Cookies. Certain features of our Services may use local stored objects (or Flash cookies) to collect and store information about your preferences and navigation to, from, and on our Services. Flash cookies are not managed by the same browser settings as are used for browser cookies. Information We Collect From Third Parties

In addition to the information we collect from you or through automatic means, we may collect information that is publicly available or from third-party sources. We may combine this information with your Personal Information for the purposes described herein. The information we collect from third-party sources includes, but is not limited to:

Information about you from payment and transaction fulfillment providers, such as payment confirmation details, and information about the delivery of products you have purchased through shopping features.
Information from our technical and security partners to operate and secure our Services.
Information (such as your email address, user ID, and public profile) when you decide to sign up for or login to our Services by using their login services. We could also receive this information when you decide to connect or integrate a third-party service or app with our Services. This could allow you to import your data or files from a third-party service to our Services.
In case of mergers or acquisitions, we may receive any of the aforementioned information.

Interactions with Third Parties

Articles and other information shared on this site may include embedded content (e.g. videos, images, articles, etc.). These third parties may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content.

In addition to the third-party content above, we currently engage Google Analytics, a web analytics service provided by Google, Inc. (“Google”) to help us analyze how users use the Services. Google Analytics uses cookies and similar technologies to collect information that does not include your Personal Information to help us evaluate your use of the Services, compile reports on Services activity and provide other information related to Services usage. We may permit Google and, from time to time, other such third-party analytics providers to combine information collected through our Services with information collected from third-party services, and these analytics providers may use this information to help us better understand our users. We also utilize OpenAI's application program interface to power portions of the AI functionality of our Services. We expressly disclaim any and all liability for the actions of third parties. The privacy practices of any third parties are outside the scope of this Privacy Policy and their use or disclosure of your information (including your Personal Information) will be governed by their own privacy practices or policies. We encourage you to review the privacy practices or policies of those third parties.

Information Use

We use information that we collect about you or that you provide to us, including any Personal Information:

To present our Services and its contents to you.
To analyze your photo content and metadata to help you tag and organize your photos to create products, to make personalized product suggestions and recommendations to you, such as showing you how your pictures may look in a collage or other products. We may send you reminders and suggestions based on the information you include in your projects, such as birthdays and anniversaries.
To provide you with information, products, or services that you request from us or information, products, pricing models or services that we think you may be interested in.
To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.
To provide you with customer and technical support, investigate your concerns, respond to your inquiries and to monitor and improve our responses to your and other users’ inquiries in relation to the Services.
To conduct research, analytics and monitor performance and other metrics regarding our Services and your use of the Services.
To notify you about changes to our Services or any products or services we offer or provide through it.
To allow you to participate in interactive features on our Services.
To fulfill any other purpose for which you provide it.
For any other purpose with your consent.

Information Sharing

We do not sell, lease or trade your biometric identifier or biometric information, but we may disclose the information we process about you, including any Personal Information, as follows:

We may share your information, including your Personal Information, with third-party service providers that help us run the Services or facilitate the Services. Such service providers may include hosting providers, third-party payment processors and third-party retailers that help us print and deliver the photos you upload to the Services.
We may share your Personal Information with businesses that are legally part of the same group of companies that we are part of, including our subsidiaries.
We may share your information to monitor or improve our Services.
We may share information with third parties in limited circumstances, such as complying with legal processes, cooperating with law enforcement, preventing fraud or imminent harm, ensuring the security of our network and services, when we believe your actions violate our Terms and Conditions, or in the event we are transferred or sold to another entity as a result of a corporate sale, merger, consolidation, asset sale, or in the unlikely event of bankruptcy.
We may disclose your Personal Information in other circumstances with your prior informed consent.
We may disclose Aggregated Statistics (as defined in the Terms of Service) that do not identify any individual without any restriction.

Information and Photo Retention

We retain the information we collect from you for as long as we deem necessary to fulfill the purposes outlined in this Privacy Policy unless otherwise required and authorized by applicable law.

We will retain your photos for as long as you maintain an account with us and grant us permission to access your photos. You may decide to delete all of your photos in your account and delete the app. In order for your photos and information to be permanently removed from the App, our servers and our hosting providers’ servers you must request we do so. Your Access to and Control Over Information

We strive to provide you with choices regarding the Personal Information you provide to us. We have created mechanisms to provide you with the following control over your information:

Tracking Technologies and Advertising. You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your Personal Information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by checking the relevant box located on the form on which we collect your data. You can also always opt-out by adjusting your user preferences in your account profile or by sending us an email with your request to [EMAIL ADDRESS].

Contacts Directly From Memory My Way. You may opt out of any future contacts from us at any time. You can contact us to do the following:

See what data we have about you, if any.
Modify any data we have about you.
Delete any data we have about you.
Express any concern you have about our use of your data.

If you would like to access, modify, or delete your Personal Information, you may submit a request to [EMAIL]. Residents of certain states, such as California, Nevada, Colorado, Connecticut, Virginia and Utah may have additional Personal Information rights and choices. Please see the Your State’s Privacy Rights section below for more information. We will promptly review all such requests in accordance with applicable laws.

Security

We take precautions to protect your information. When you submit sensitive information via the Services, your information is protected both online and offline. Wherever we collect sensitive information, that information is encrypted and transmitted to us in a secure way.

The computers servers in which we store personally identifiable information are kept in a secure environment.

We will make our best efforts to protect your information, but we cannot, however, ensure or warrant the security of any information that you transmit to us or store on the Services, and you do so at your own risk. We also cannot guarantee that such information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or administrative safeguards.

Children’s Online Privacy Protection Act

The Services are intended for general audiences 18 years of age or older. The Services are not directed to children under 13 years old. We do not target the Services to children under 13, and we do not intentionally collect any information from users under 13. If you are under 13, do not use or provide any information through the Services. If you become aware that a child has used the Services, and we may have Personal Information about a user under 13, please contact us at hello@meet-mae.com so we may delete the information.

Your State Privacy Rights

State consumer privacy laws may provide their residents with additional rights regarding our use of their Personal Information.

Shine the Light

We do not disclose Personal Information to third parties for those third parties’ own direct marketing purposes.

Notice of Collection

In the past 12 months, we have collected the following categories of Personal Information enumerated in the CCPA:

Identifiers, including name, email address, phone number, and IP address.
Internet activity, including your interactions with our Services.
Employment and education data, including information you provide when you apply for a job with us or when you engage with the Services.
Inferences, including information about your interests, preferences and favorites.
Government-Issued Identifiers such as Social Security Numbers or passports from our individual users, prospective users, or others, who are California residents and not representatives of businesses, if and to the extent necessary to provide legal services.

Right to Know and Delete

Consumers who are California residents (and not representatives of businesses, whether those businesses are our clients or others) have the right to know certain information about our data practices in the preceding 12 months. In particular, they have the right to request the following from us:

The categories of sources from which the Personal Information was collected;
The categories of Personal Information about them that we disclosed for a business purpose or sold;
The categories of third parties to whom the Personal Information was disclosed for a business purpose or sold; and

In addition, in certain circumstances, California consumers have the right to delete the Personal Information we have collected from them.

You can designate an authorized agent to submit requests on your behalf. However, we will require written proof of the agent’s permission to do so and verify your identity directly.

Do Not Sell My Personal Information

We do not sell Personal Information as the term “sell” is defined under the CCPA.

Right to Non-Discrimination

You have the right not to receive discriminatory treatment by us for the exercise of any of your rights.

Additional State Disclosures

Colorado, Connecticut, Virginia, and Utah each provide their state residents with rights to:

Confirm whether we process their Personal Information.
Access and delete certain Personal Information.
Data portability.
Opt-out of personal data processing for targeted advertising and sales.

Colorado, Connecticut, and Virginia also provide their state residents with rights to:

Correct inaccuracies in their Personal Information, taking into account the information's nature processing purpose.
Opt-out of profiling in furtherance of decisions that produce legal or similarly significant effects.

International Users

The Services are hosted in the United States and are intended primarily for visitors located within the United States. If you choose to use the services from outside the United States or in a jurisdiction with laws governing data collection and use that may differ from the laws of the United States, you hereby authorize and consent to the transfer of your Personal Information outside of such region and to the United States, or any other jurisdiction to be determined in our sole discretion, for data storage and processing purposes.

While we do not specifically target our goods or services to individuals outside of the United States, it understands that certain App visitors may be considered “data subjects” for whom the processing of Personal Information would normally be subject to REGULATION (EU) 2016/679 (“GDPR”) or the U.K. General Data Protection Regulation (“UK GDPR”) (each, a “Covered Person”).

While Memory My Way is not subject to GDPR or the UK GDPR because it does not target its goods and services to individuals outside of the United States, it voluntarily offers Covered Persons the rights described below:

Right of access, rectification, erasure, and restriction of processing: The user may obtain access to the user’s Personal Information stored by us. If we process or use the user’s Personal Information, we shall endeavor to ensure, by implementing suitable measures, that the user’s Personal Information is accurate and up to date for the purposes for which it was collected. If the user’s Personal Information is inaccurate or incomplete, the user may obtain the rectification of such Personal Information. The user may obtain the erasure or restriction of processing of the user’s Personal Information in situations where no legitimate business purpose exists, or the further storage is unnecessary.
Right to data portability: The user may receive the Personal Information about such user that the user has provided to us, in a structured, commonly-used, and machine-readable format or transmit this information to another controller.
Right to object: The user may object, on grounds relating to the user’s particular situation, to the processing of the user’s Personal Information. To the extent the user’s Personal Information is processed for reasons other than direct marketing, the user understands and agrees that we have compelling legitimate reasons for information processing, such as providing access to our Services. The user may use ad-blocking software to limit information capture and usage. Making a request does not guarantee that the request will be honored.
